These Terms of Use (“Terms”) govern your access to and use of Ticgetz Gold — the digital gold and silver service offered through the Ticgetz website and mobile applications (together, the “Platform”). By creating an account or buying, selling, holding or redeeming digital gold or silver through the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy, which are incorporated by reference. If you do not agree, please do not use Ticgetz Gold.
1.About Ticgetz and These Terms
“Ticgetz” is a brand and trademark operated by RGB Net Productions, a sole proprietorship wholly owned by Mr. Trishar Arun, based in Bengaluru, Karnataka, India. RGB Net Productions is the sole legal entity responsible for the Ticgetz platform. References to “Ticgetz”, “we”, “us” or “our” in these documents mean RGB Net Productions.
These Terms constitute a legally binding agreement between you (the “User”, “you”) and RGB Net Productions and are an electronic record under the Information Technology Act, 2000 and the rules made thereunder. They do not require any physical or digital signature to be binding.
2.What Ticgetz Gold Is
Ticgetz Gold lets you buy, accumulate, sell and redeem 24K (999.9 fineness) gold and 999 fineness silver in digital form, in amounts as small as ₹1 worth, at live market-linked prices.
Every gram you buy is backed by an equivalent quantity of physical metal held in insured, third-party vaults. You may sell your holding back at the prevailing rate, or redeem it as physical coins, bars or articles delivered to your address, subject to availability and the applicable making and delivery charges.
3.Our Role and Our Partner
Ticgetz is a technology and distribution platform. The underlying digital gold and silver product — including purchase and sale execution, sourcing, assaying, vaulting, insurance, invoicing and physical fulfilment — is provided by our partner Augmont Goldtech Private Limited (“Augmont”), a regulated bullion company.
When you transact, Ticgetz collects your payment and instructs Augmont, which allocates the metal to you and holds it in your name in its vaulting arrangement. Ticgetz does not itself hold, vault or take title to your metal. Your use of Ticgetz Gold is therefore also subject to Augmont's applicable terms, which we make available on request. Ticgetz is not a bank, non-banking financial company, or a registered investment adviser.
4.Eligibility
You must be at least 18 years of age, resident in India, and legally competent to contract under the Indian Contract Act, 1872. Ticgetz Gold is offered only to Indian residents and transactions are settled only in Indian Rupees. By transacting you represent that the funds you use are from lawful sources and that the information you provide is true, current and complete.
5.Accounts, Authentication and Security
Access requires an account verified by one-time password (OTP) sent to your mobile number. Because Ticgetz Gold holds value, you may additionally secure your account with an MPIN and, on supported devices, biometric unlock.
You are responsible for keeping your MPIN, device and account credentials confidential and for all activity under your account. Notify us immediately at care@ticgetz.com of any unauthorised use. We may limit the number of devices linked to an account, and may suspend transactions where we detect suspicious activity.
6.KYC and Regulatory Compliance
Identity verification (KYC) is required beyond the transaction thresholds set by our partner and by applicable law, and may be required earlier at our or Augmont's discretion. You agree to provide accurate identification documents (such as PAN and proof of address) when requested.
Until KYC is completed, your cumulative purchases in a financial year are capped, and transactions that would breach the cap will be declined. We may refuse, limit, suspend or reverse any transaction, and may withhold redemption, where KYC is incomplete, documents appear inauthentic, or where required to comply with anti-money-laundering or other legal obligations.
7.Pricing, Charges and Taxes
Prices are live and market-linked. Buy and sell prices are quoted by Augmont and refreshed continuously; there is a spread between the buy price and the sell price at any moment, which is disclosed on the transaction screen before you confirm.
- Goods and Services Tax (GST) at the applicable rate (currently 3% on bullion) is charged on every purchase and shown separately before you pay.
- The price you are shown is locked for a short window (approximately five minutes) while you complete payment. If the lock expires, the rate is refreshed and you must confirm again.
- Redemption into physical products attracts making charges and, where applicable, delivery charges, both shown before you confirm the order.
- Ticgetz does not currently levy a separate platform or convenience fee on Ticgetz Gold transactions. If that changes, the fee will be displayed before you confirm any transaction.
Payments are processed by a Reserve Bank of India authorised payment aggregator (Cashfree Payments). Card details are handled and, where applicable, tokenised by the aggregator; we do not store your full card number. By transacting you also agree to the payment provider's terms.
8.Buying, Selling and Holding
A purchase is executed at the rate locked at the time you confirm, once your payment is successfully received. On execution, the corresponding quantity of metal is allocated to your holding and an invoice is issued.
A sale is executed at the prevailing sell rate and the proceeds are credited to the bank account you have registered and verified, typically within 1–3 business days.
Because both are executed against a live market rate, buy and sell transactions are final and irreversible once executed. They cannot be cancelled, reversed or “undone” on account of a subsequent change in price. Your holding does not earn interest, dividend or any assured return.
9.Storage, Insurance and Title
Metal you purchase is held in allocated form in secure vaults managed by Augmont's custodian and is insured while in storage. Ticgetz charges no storage fee for the periods stated on the Platform. Title to the metal rests with you; Ticgetz does not lend, pledge, lease or otherwise deal with your holding, and does not use it as collateral.
10.Redemption and Physical Delivery
You may convert your digital holding into physical coins, bars or articles from the available catalogue, provided your balance covers the redeemable weight of the item and you pay the applicable making and delivery charges. Redemption is subject to minimum weights, stock availability and completed KYC.
Products are dispatched by an insured logistics partner to the address you provide. You are responsible for the accuracy of that address. Please inspect the tamper-evident packaging on delivery and refuse any consignment that appears opened or damaged, reporting it to us the same day. Once a redemption order is placed with Augmont and the metal is debited from your holding, it cannot be cancelled or converted back into digital form.
11.Systematic Purchase Plans (SIP)
Where offered, a systematic purchase plan lets you authorise recurring automatic purchases of a fixed rupee amount at a chosen frequency, using a payment mandate. Each instalment buys metal at that day's prevailing rate, so the quantity received varies. You may pause or cancel a plan at any time from your account; cancellation stops future instalments but does not reverse instalments already executed. Failed instalments may be retried by the payment provider in accordance with the mandate.
12.Market Risk — No Investment Advice
The price of gold and silver fluctuates and is influenced by international bullion prices, currency movements, import duties, taxes and market demand. The value of your holding can go down as well as up, and you may receive less than you paid.
Digital gold is not a bank deposit, a security, a mutual fund or a guaranteed-return product, and it is not covered by deposit insurance. Nothing on the Platform — including rate charts, calculators, projections or educational content — constitutes investment, financial, legal or tax advice, or a recommendation to transact. Please make your own assessment and seek independent advice where appropriate.
13.Acceptable Use and Prohibited Conduct
You agree not to: • use Ticgetz Gold for money laundering, terrorist financing, tax evasion or any unlawful purpose; • transact using funds that are not lawfully yours, or on behalf of an undisclosed third party; • provide false, forged or another person's identification or bank details; • attempt to hack, scrape, overload, reverse-engineer or disrupt the Platform or its security; • use bots or automated means to transact or to exploit rate-lock windows; or • use the Platform in violation of any applicable law. Violation may lead to suspension of your account, reversal or blocking of transactions, reporting to the relevant authorities, and legal action.
14.Intellectual Property
“Ticgetz” is a trademark of RGB Net Productions. All content, branding, logos, software, design and materials on the Platform are owned by or licensed to RGB Net Productions and are protected under applicable intellectual-property laws. You may not copy, modify, distribute, sell or create derivative works from any part of the Platform without our prior written permission. Augmont's marks and product imagery remain the property of Augmont.
15.Third-Party Services
Ticgetz Gold depends on third parties — Augmont for the underlying product, vaulting and fulfilment; a payment aggregator for payments; and a logistics partner for delivery. We do not control their systems and are not responsible for their independent acts or omissions, though we will assist you in good faith in resolving any issue arising through them. Your use of those services is governed by their own terms.
16.Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that live rates will always be available — rate feeds and transactions may be suspended during market volatility, upstream outages or maintenance. Nothing in these Terms excludes any liability that cannot be excluded under applicable law, including under the Consumer Protection Act, 2019.
17.Limitation of Liability
To the maximum extent permitted by law, RGB Net Productions, its proprietor and personnel shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits or goodwill, arising out of or relating to your use of Ticgetz Gold — including any loss arising from movements in the price of gold or silver. Our total aggregate liability for any claim arising out of or relating to a transaction shall not exceed the amount actually received and retained by Ticgetz for that specific transaction. Nothing here limits your right to receive the metal you have paid for, or a refund where a transaction fails.
18.Indemnification
You agree to indemnify and hold harmless RGB Net Productions, its proprietor, employees and partners from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.
19.Suspension and Termination
We may suspend or terminate your access, or block a transaction, with or without notice, if we reasonably believe you have breached these Terms or applicable law, if KYC is incomplete or unsatisfactory, or to protect the Platform, other users or the public. Suspension of access does not affect your title to metal already allocated to you; on closure of your account you may sell your holding or redeem it as physical product, subject to completing any outstanding KYC.
20.Changes to These Terms
We may update these Terms from time to time to reflect changes in law, our services, our partners or business practices. The updated version will be posted on the Platform with a revised “Last updated” date, and your continued use after such posting constitutes acceptance. Material changes will be notified to you.
21.Governing Law, Jurisdiction and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Subject to the grievance-redressal process below, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction, and the parties may refer disputes to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat and venue at Bengaluru and proceedings in English. Nothing in this clause limits any statutory consumer rights or remedies available to you under the Consumer Protection Act, 2019.
22.Grievance Redressal
In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, the details of the Grievance Officer are:
